1. Introduction

Welcome to Solenvo3D ("we," "our," or "us"). By accessing or using our website, services, applications, or other content (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Services.

2. Changes to the Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes through the Services or by other means. Your continued use of the Services after such notice constitutes your acceptance of the modified Terms.

3. Services Description

Solenvo3D provides 3D reconstruction services using gaussian splatting technology. Our Services include, but are not limited to, transforming user-provided images into 3D models. The Services are currently in beta, and as such, may have limited availability, features, or functionality.

4. User Accounts

Some aspects of our Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to update it as necessary. You may not impersonate anyone else or select a username that violates someone else's rights.

5. User Content

By uploading images or other content to our Services ("User Content"), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, distribute, and display such content for the purpose of providing and improving our Services. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate the rights of any third party.

6. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law or regulation
• Infringe upon the rights of others
• Upload or distribute malicious code or content
• Attempt to gain unauthorized access to any part of the Services
• Interfere with the proper operation of the Services
• Create 3D models of content that is illegal, obscene, defamatory, or otherwise objectionable

7. Intellectual Property

The Services, including all content, features, and functionality, are owned by Solenvo, our licensors, or other providers and are protected by copyright, trademark, patent, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as permitted by these Terms.

8. Third-Party Services

Our Services may incorporate or link to third-party services, including the SuperSplat viewer. We are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with such services are solely between you and the third party.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, secure, or error-free, particularly given the beta nature of the Services. Server availability may be limited during this phase.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Solenvo and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Services, your User Content, or your violation of these Terms.

12. Termination

We may terminate or suspend your access to the Services at any time, with or without cause, without prior notice or liability. Upon termination, your right to use the Services will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Solenvo is established, without regard to its conflict of law provisions.

14. Dispute Resolution

Any dispute arising from or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the applicable arbitration rules of the jurisdiction in which Solenvo is established. The arbitration shall be conducted in English.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
